These Terms of Service (“Terms”) apply to your use of the Augusto Ju Nior website and webshop, including the purchase of products through our online store.

By accessing our website or placing an order, you agree to these Terms. Please read them carefully before using our website or purchasing our products.

Augusto Ju Nior is an independent fashion and design brand.

  1. USE OF OUR WEBSITE

You may use our website for lawful purposes only.

You agree not to misuse the website, interfere with its operation, attempt to gain unauthorized access to any part of the website or use the website in a way that may damage Augusto Ju Nior, our services or other users.

We reserve the right to restrict or terminate access to our website where reasonably necessary, including in cases of misuse or unlawful activity.

  1. OUR PRODUCTS

We make every effort to present our products as accurately as possible.

Product images, colours and appearances may vary depending on your screen, device settings and lighting conditions. Minor differences in colour, finish or appearance do not necessarily constitute a defect.

Product descriptions, specifications, availability and images may be updated from time to time.

Some products may be available in limited quantities. We reserve the right to discontinue products or change product availability at any time.

Nothing in these Terms limits your statutory consumer rights.

Certain products may require specific care or handling instructions.

Customers are responsible for following the care and handling instructions provided with the product or on our website.

Failure to follow applicable care instructions may result in damage that is not considered a manufacturing defect.

  1. ORDERS

When you place an order through our webshop, you are making an offer to purchase the selected products.

After placing your order, you will receive an order confirmation by email. This confirmation acknowledges that we have received your order; it does not necessarily mean that the order has been accepted for shipment.

We reserve the right to refuse or cancel an order in reasonable circumstances, including where:

  • a product is unavailable;

  • there is an obvious error in the product description or price;

  • we suspect fraudulent or unauthorized activity; or

  • we are unable to fulfil the order for reasons outside our reasonable control.

If we cancel an order after payment has been made, we will refund the amount paid for the cancelled order.

  1. PRICES AND PAYMENT

All prices displayed on our website are shown in the applicable currency and include VAT where required by applicable law.

Shipping costs are calculated separately and displayed at checkout before you complete your purchase.

Prices may change from time to time. Any price change will not affect an order that has already been accepted and confirmed by us.

We accept the payment methods made available at checkout.

You confirm that the payment information you provide is accurate and that you are authorized to use the selected payment method.

  1. SHIPPING AND DELIVERY

We ship internationally.

Orders are generally processed within 1–3 business days after payment has been received.

Delivery times depend on the destination and shipping method selected at checkout.

Estimated delivery times are provided as an indication and may be affected by circumstances such as carrier delays, customs procedures, public holidays or other events outside our reasonable control.

Where we are responsible for arranging delivery, the risk of loss or damage remains with Augusto Ju Nior until the goods are delivered to you, as required by applicable consumer law.

  1. CUSTOMS AND IMPORT CHARGES

Orders shipped outside the European Union may be subject to customs duties, import taxes or other charges imposed by the destination country.

Unless otherwise stated at checkout, such charges are the responsibility of the customer.

Augusto Ju Nior does not control the customs procedures, fees or requirements imposed by the destination country.

  1. RIGHT OF WITHDRAWAL

If you are a consumer purchasing from within the European Union or another jurisdiction where a statutory withdrawal period applies, you generally have the right to withdraw from your purchase within 14 days without giving a reason.

For goods, the withdrawal period normally begins on the day you, or a person designated by you other than the carrier, receives the goods.

If you exercise your right of withdrawal, you must notify us within the applicable withdrawal period and return the product in accordance with our Return & Refund Policy.

The product should be handled only to the extent necessary to establish its nature, characteristics and functioning. You may be responsible for any diminished value resulting from handling beyond what is reasonably necessary to inspect the product.

Unless otherwise required by applicable law, the direct cost of returning an item under the right of withdrawal is the responsibility of the customer, provided this was communicated before purchase.

Certain products may be excluded from the statutory right of withdrawal where a legal exception applies.

  1. REFUNDS

Where you validly exercise your right of withdrawal, we will refund the payments we are required to refund under applicable law.

Refunds will generally be made using the same payment method used for the original transaction, unless otherwise agreed.

Where applicable, we may wait with the refund until we have received the returned goods or until you provide evidence that the goods have been returned, whichever occurs first.

  1. FAULTY OR NON-CONFORMING PRODUCTS

Nothing in these Terms affects your statutory rights relating to faulty, damaged or incorrectly supplied products.

If a product is defective or does not conform to the agreement, you may have the right to a repair, replacement, price reduction or refund, depending on the circumstances and applicable law.

EU consumer law provides a minimum legal guarantee for defective or non-conforming goods, subject to applicable national rules.

If you believe you have received a defective or incorrect product, please contact us at info@augusto-ju-nior.com as soon as possible with your order number and, where relevant, photographs of the issue.

  1. DAMAGED ORDERS

If your order arrives visibly damaged, please contact us as soon as possible.

Please provide your order number and photographs of the product and packaging where possible. This allows us to investigate the issue with the carrier and determine the appropriate solution.

This does not limit your statutory consumer rights.

  1. INTELLECTUAL PROPERTY

All content on the Augusto Ju Nior website, including but not limited to our name, logo, branding, photographs, images, designs, graphics, text, product designs, videos, artwork and other creative materials, is owned by or licensed to Augusto Ju Nior unless otherwise stated.

You may not reproduce, copy, distribute, modify, publish, sell, exploit or otherwise use our content for commercial purposes without our prior written permission.

The Augusto Ju Nior name, logo and associated brand elements may not be used without our prior written permission.

  1. USER CONTENT AND FEEDBACK

If you voluntarily submit reviews, feedback, photographs, comments or other content to us, you confirm that you have the necessary rights to provide that content.

You must not submit content that is unlawful, misleading, defamatory, offensive or infringes the rights of another person.

By submitting content that you voluntarily allow us to use for marketing or promotional purposes, you grant Augusto Ju Nior permission to use that content for those purposes, subject to applicable law and any specific agreement we have with you.

Nothing in these Terms limits your statutory consumer rights or our legal obligations concerning products sold through our webshop.

We are not responsible for failure or delay in performing our obligations where this is caused by circumstances beyond our reasonable control.
